P.K.Sinha ji, Member(F), DoT regarding the payment of balance amount of First Installment of Ex-gratia and second installment of Ex-gratia as a***ured i.e before 30.6.2020. Member (F) mentioned that an amount of Rs.3600 Crs towards ex-gratia payment in respect of VR retirees will be released before 30.6.2020 from the funds available in DoT. The balance amount will be released in July 2020 after the receipt of the same from the Ministry of Finance. |

In continuation of the Agenda meeting with Director(HR) on 09.06.2020, General Secretaries of AIBSNLEA & SNEA AGS/AIBSNLEA, President/SNEA and AGS of SNEA met CMD/BSNL and had detailed discussions on promotion to different Grades through CPSU Hierarchy and other important issues. |

1. Regular Promotion to different Grades: After his take over, first time CMD has given time for a detailed discussions on the Promotion Policy and its implementation. |

We explained to CMD that the new Promotion Policy of Non post based Time Bound functional promotion, approved by the Board is part of the Terms and condition for absorption in BSNL. All other CPSUs are following Time Bound functional promotions, very smoothly. When EPP 2007 implemented, BSNL diluted it and allowed only Pay Scale up gradation and continued with Post based promotions followed in Govt Depts. This resulted in Seniority and Reservation cases. BSNLMS RR has been notified in 2009 only, which is another 10 years loss for BSNL Executives. |

As per the new Promotion Policy approved by the BSNL Board, Promotions are due from 01.07.2018, but the implementation is unduly delayed. For its smooth implementation from 01.07.2018, all the vacancies have been filled up in June, 2018. To overcome the court cases, upgradtion of posts done for AO and AGM promotions. Unfortunately, the court cases on reservation related issues landed AO and AGM promotions in trouble and Hon’ble Chandigarh CAT declared AO and AGM promotions issued during June 2018 as provisional putting a big question mark on the above said Promotions orders issued in June 2018 and future promotions. Any Post based promotion will end up in such litigations, we are afraid. |

On the query from CMD on the reference to DoT, we explained that it has been sent to DoT for guidance, not for approval. As per DoT instructions, issues having financial implications only to be referred to DoT for concurrence/approval. If at all any guidance is received on the reservation matter, it will be applicable from the date of effect and as such there is no need for delaying the promotion, we told. Govt guidelines from time to time will be applicable on BSNL. |

After VRS, more changes are to be made, especially for promotion to AGM/CAO Grade by reducing the residency period from 12 to 8 years for the existing SDE/AOs etc in higher scales. Since thousands of Executives are eagerly waiting for promotion, we requested to implement the promotions at the earliest. JTOs in all Streams are worst affected, 1999 rect to 2014 rect JTOs are waiting for promotion. We informed the CMD about the details of meeting held with DIR(HR) and the proposed presentation to the Board members. |

3. Various pending payments and payment of Superannuation Fund contribution: CMD informed that about 550 Cr due towards Society payments cleared in this month. As usual Priority is given for maintenance and release of funds for various heads, electricity, rent, labour etc., For Superannuation Fund, 67 Cr is required and Management is trying to arrange the same. According to fund availability, May 2020 Salary disburs*****t is possible after one week. On medical bills, CMD informed that some payment will be made in June salary. |

In the last meeting held on 05.05.2020, it was concluded that due to court cases and reservation related issues, implementation of Non-post based Time Bound promotion policy OR CPSU Hierarchy approved by the BSNL Board on 28.05.2018 will be expedited and Pers. section will work out on that. We explained that due to various court cases, promotions are held up for years together and to overcome that, CPSU Hierarchy is approved by the BSNL Board on 28.05.2018. It is as per the terms and conditions mentioned in the Presidential orders issued to the Executives at the time of absorption in BSNL. The promotion orders issued in June, 2018 also under litigations and Hon CAT/Chandigarh declared the AO and DE promotions PROVISIONAL and directed BSNL to review the promotions. JTO to SDE promotion also under litigation at CAT/Ernakulam. Hence no other option left for BSNL to give promotions. |

We were very firm on our demand for promotion w.e.f. 01.07.2018 itself as it will ensure parity in promotions and protect the seniority with those promoted in June 20 1 8 and counting of 2 years service for the future promotions. Due to litigations, JTO to SDE promotion is pending since 2011 except some promotion in 2018. Almost all the promotions held up between 2015 to 2018 due to reservation issue. To compensate those damages, Management itself proposed CPSU Hierarchy w.e.f. 01.01.2017 itself but Board approved it w.e.f 28.05.2018. We explained that earlier also, EPP and SDE RR amendment etc., implemented retrospectively. i) EPP approved and notified on 18.01.2007 but implemented from 01.10.2000 onwards with all consequential benefits from 01.10.2004. ii) SDE RR amendment notified on 08.05.2018, effectively from 28.08.2015, the Board approval date. |

On DGM(T/F) Adhoc to Regular promotion, we demanded their regular promotion. Now the number of vacancies are much higher than the eligible AGM/CAOs. On DGM(T) Adhoc to Regular promotion, Management informed about the seniority revision and legal aspects will be examined for giving regular promotion. Since there is no seniority issue, DGM(F) Adhoc to Regular promotion may be processed. |

Due to abnormal delay in promotions to AGM and CAO Grades, sufficient AGM and CAOs are not available for promotion to DGM Grade. More than 90% of the posts are lying vacant. At the same time Management utilising their service as DGM by LA arrangement. We demanded their regular promotion as DGM by relaxing the qualifying service. Al of them got sufficient experience as AGM/CAO by LA/Officiating/regular service. Management accepted that there is operational requirement and in principle agreed our demand. Finalization of number of DGM posts through Restg., will be finalized by this month end. Thereafter proposal will be moved. |

c) Agenda meeting for Non recognized a***ociations: |

We strongly objected the Management action and told DIR(HR) that there is no need for Members***p Verification at all as there is no distinction between Recognized/ applicant /non-applicant a***ns. All are given meetings even on Policy matters and Management is using them against the Recognized a***ociations making Members***p Verification and Recognition Rules irrelevant. The very purpose of Members***p Verification was to end multiplicity of a***ociations but it is defeated by the Management. Due to the Divide and Rule policy of the Management, resolution of the HR issues are getting delayed and the Executives are suffering. |

Management explained that no Agenda meeting is given to any other a***ociation other than Recognised a***ociation. All the meetings given to other a***ociations are only informal. It will be taken only as a feedback to the Management. On important matters and Policy matters, Management will consider the opinion of the Recognised a***ociations only, as per the Recognition Rules. |

d) Hike in SAB contribution and payment of SAB contribution: |

We demanded hike in Superannuation Benefits (SAB) contribution as a***ured by the Management earlier and payment of SAB contribution to LIC from August, 2019 onwards. SAB is the Social Security for the BSNL directly recruited employees and it has to be given top most priority after Salary, we demanded. Since the SAB contribution payment to LIC is pending, the VRS optees retirement claim from Superannuation Fund also not settled so far. |

On pending payment of SAB contribution, Management agreed to take up with the concerned. Hike in SAB contribution will be examined by the Management, it is a***ured. |

e) Pending Modification in DGM(T) promotions –majority of them worked outside the Home Circle and came back after 3 years: |

We explained that as AGMs they were worked outside the Home Circle and came back to their Home Circle after 3 years. Again on DGM promotion, they have been transferred out from their Home Circle. As all are worked outside, they may be posted in the same Circle itself. Management informed that the cases will be considered. |

1. Fund availability and payments: We draw the attention of the Director (Fin) regarding various pending payments like labour, Rentals, SAB dues etc. The labour payment is due for more than one year. Director (Fin) informed that the cash collection improved during May 2020 and BSNL could collect Rs 1,400 Cr. The cash collection during April 2020 was Rs.1,150 Cr only. First priority will be for allotment of funds for maintenance and Statutory payments. For labour payments, 15Cr will be allotted today (03.06.20), DIR (Fin) informed. Regarding May, 2020 Salary disburs*****t, it may be feasible next week end. |

2. Promotions to various Cadres: We draw his attention to the huge stagnation and shortage of Executives in many Cadres and sought his intervention. The Executives are working in higher scales and they can be promoted as per the policy approved by the BSNL Board within no time. DIR(Fin) also felt that major works are getting suffered due to shortage in Key posts and a***ured to discuss with DIR(HR) for early promotions. |

3. Drastic post reduction: We strongly protested against the decision of the BSNL Management to transfer all TR work to Circle Office and requested that it has to be reviewed immediately as it is not feasible. We suggested that for very small SSAs, it can be centralised but medium and larger SSAs TR work to be continued with the SSA for effective bill collection and persuasion, settling of billing related complaints, Outstanding Pursuit, handling of EB Customers etc., DIR(Fin) very much convinced on our suggestions and noted down all the points and a***ured to discuss with DIR(CFA) and CMD. In this regard, AIBSNLEA has already written a letter to CMD BSNL with a copy to Director (Finance) for review the policy. |

4. SAB dues payment to LIC : We brought to the notice of DIR (Fin) that SAB dues payment to LIC is pending since August 2019. Some VRS optees cases also not settled as the dues are not paid to LIC. We demanded immediate payment of contribution to LIC. DIR(Fin) a***ured to examine the matter and do the needful. |

Monthly Review Meeting with Recognized a***ociations and Unions: We appraised DIR (Fin) about the meeting of Recognized a***ns. and Unions with CMD and sharing of Monthly Revenue and Expenditure details with the Stake Holders and monthly review meeting with the Recognized a***ns. and Unions so as to improve the efficiency of the Company and maximisation of Revenue and controlling of unnecessary expenditure. DIR(Fin) appreciated our concern and mentioned that the Management is reviewing the monthly revenue and expenditure and planning for Revenue Maximisation and he a***ured that after the completion of the work it will be shared with Stake Holders for discussion. |

It is learned that through Restructuring and Review of a***ets, BSNL Management is considering drastic reduction in the combined strength of AGM and DGM equivalent Grades in all the Streams (Telecom, Finance, Civil, Electrical, Arch, TF, PPS and CSS) and AGM+DGM number in all the Streams combined together will be about 3300 – 3500. The present combined sanctioned strength of AGM+DGM is 8953. In other words, drastic reduction of posts proposed, by about 65%. The final figure will be divided in some ratio between AGM and DGM. If it happens, then it will stop almost all the promotions to AGM and DGM Grade in all Streams as we are apprehending. |

This is in the name of Restg . and M/s Deloittee recommendation. The same Consultant M/s Deloittee, in 2014, recommended an increase in the number of AGM (T) posts from 5303 to 6172 and DGM(T) posts from 1331 to 1607. After 6 years, the same Consultant makes recommendation for drastic reduction of posts. This establish that the Consultant is acting on behalf of the Management and what Management requires, that report is given by the Consultant, without making any Work Study. |

Similar cut in the number of posts can be antic****ted in other Grades also (SDE/AO and JTO/JAO equivalents). The provisional norms issued in December, 2019 by Restg. cell indicates that the Circles can work out the revised sanctioned strength of the Circle based on that provisional norms and find out the revised strength. |

Member (Fin) further mentioned that there is a meeting scheduled on 26.5.2020 with the Expenditure Secretary and Senior Officers of Finance Ministry to discuss in this regard. We explained that irrespective of category, ST/SC/OC category Executives are waiting for promotion for years together. For example, 2001 recruited JTOs of SC and OC category and 2002 Rect JTOs of ST category are waiting for promotion to SDE Grade even after completion of 18 to 19 years of service. But as per the New policy, all the JTOs completed 5 years of service, irrespective of ST/SC/OC category will get promotion. |

B) CMD is non committal on promotions: According to CMD, the restructuring may take another 6 months time. On promotion, CMD is of the opinion that it is delayed due to the Court cases and BSNL cannot be held responsible for that. We refuted the charge and told CMD that Court cases are increasing since Executives are not getting timely promotion and due to various infirmities in the RRs, procedures etc. The promotion Policy followed in BSNL is that of Govt Depts., not that of a CPSU. In other CPSUs, promotions upto certain scale is on time bound basis, when scale is given, it will be treated as functional promotion to that grade and no separate post based promotion is followed. So, Seniority and Reservation related issues are not there in any other CPSU. To overcome this, BSNL already approved amendments to the EPP to give functional promotion to the scale upto AGM/CAO/EE Grade in of E4 scale. |

We explained the difficulties faced by the employees for treatment. Since the bills are pending since May, 2019, majority of the good Hospitals are not extending treatment to BSNL employees. Since good hospitals are not in the panel, employees are not getting proper treatment. Management has to expedite the process of working out good Medical Insurance scheme, we demanded. CMD informed that the fund availability is the main problem and if lock down was not there, BSNL planned to clear the medical bills by April. For Medical Insurance also, BSNL require money and the present financial condition is not good and we are not in a position to make advance payment now. CMD mentioned that Salary and Mtce., Expenditure are the Company’s first priority and without releasing fund for Mtce., Revenue will not be generated. He further informed that when Salary payment itself is delayed, we cannot take advance payment immediately. |

We demanded regular promotion along with the Pay scales instead of LA promotion. |

At the beginning, the possibility of DPC in different cadres explored by the management and discussed various options. On JTO to SDE promotion, initially management was of the impression that once the Ernakulam case is cleared, promotion is possible. Further management a***essed the status of promotion in different cadres: i) JTO(Civil/Elect/Arch) to SDE(C/E/Arch) LDCE is held up due to court case on Reservation, ii) SDE(T) to DE(T) and JAO to AO promotion made in June 2018 challenged in the Hon’ble Chandigarh CAT on Reservation issue and the CAT ordered to review the promotions, declaring the promotion as PROVISIONAL, iii) AO to CAO Promotion held up due to court case on Reservation, iv) SDE(C) to EE(C) Promotion held up due to seniority issue among Diploma and Engg Degree holders. On DE (T) and AO promotions in 2018, Management is waiting for the judgement copy and the course of action is to be decided. Different options also discussed. In any case, DPC for DE and CAO is not possible before the review, Management informed that all the promotions are leading to fresh litigations. DoPT is not giving any direction regarding method of implementation of reservation or endorsing the Hon’ble Supreme Court order on reservation. DoPT asked BSNL to wait for the outcome of remaining SLPs pending in the Hon’ble Supreme Court, BSNL management informed us. In such situation, after taking various Supreme Court orders and the court cases going on into consideration, DIR(HR) come to the conclusion that in the near future, it may not be possible to give any promotion due to the reservation issue. Finally management informed us that for JTO to SDE promotion also, BSNL will not be able to decide due to the reservation issue and go for DPC even if Ernakulam judgment is coming. |

When all other options closed, now Management started seriously thinking about the implementation of Time Bound functional promotion upto AGM Grade. Management informed us that they will work on it in the coming days and discussions will be held with us if required. Both GSs once again clearly told the Management that if the Management desires to give promotion, Time bound promotion is the only viable option and work for that. |

Finally it was a***ured that the Management will explore the possibility for relaxation of the qualifying service for DGM(T/F) promotion by taking it to the Board. |

He further requested to take immediate steps to issue necessary revised instructions to contain the spread of COVID-19. as detailed below and handed over the letter addressed to CMD and copy to Director(HR). PROSPEROUS 1.BSNL CO, Circle Offices and SSA Offices (Administrative) may be closed or functioned with skeletal Staff and work at home may be allowed wherever possible and they should attend Office if called for, in case of any exigencies of work. 2. Wherever possible, the CSCs and bill collection centres may be maintained with rotation of staff with all available precautions since the CSCs are real cas***ng gateway for BSNL survival and windows for extending essential services to common public. Remaining CSCs may be closed immediately, advising the Customers to make payment through on line temporarily. The Payment date to be extended. BSNL VPN facilities to be extended to those who are working at home for CSC. 3.The Officers and Staff working in the field may be called on duty on rotation basis and allowed to work at home. All the Officers who are permitted to work at home may be provided with BSNL VPN facilities as and when needed. 4.Melas to be suspended with immediate effect. 5. BSNL focus should be limited to maintenance of of essential services, critical Installations and critical Transmission Routes. When we all BSNL family members are striving hard to bring back BSNL to its original pristine glory from its crisis period, we must not permit COVID-19 to deteriorate the motive of our work force. Thus extending all sort of life protection to every beloved members of BSNL shall be the prime most concern of the BSNL Management during the epidemic time. Release of Leave encashment and Ex-gratia payments: CMD BSNL a***ured that Leave encashment payment and Ex-gratia payment will be paid on 31st March, 2020. Already 77585 VRS cases were processed for the above cited payments. Rs. 4850 crore towards Leave encashment after TDS is being processed in LIC. Finance Ministry agreed to appropriate Rs. 5000 Crore towards the first installment of Ex-gratia payment, however, we are the short of 1300 crore towards the payment of Ex-gratia. Hence balance amount of Ex-gratia will be paid in the first week of April, 2020. |

Launching of 4G : Central Govt. made provision in the Budget FY:2020-21 towards the cost of 4G license including GST but BSNL is not in a position to take the 4G spectrum immediately due to following reasons: |

M/s Nokia installed 13000 equipment’s in the Phase 8.4 has quoted 3.5 lakh for the software/hardware upgradation from 3G to 4G and 7 lakh for green field which is L-1 subject to the conditions that Rs.300 Cr has to be paid before 31.3.2020 and compensation for Foreign Exchange fluctuation whereas M/s ZTE installed around 24,000 equipment’s has quoted 7 lakh for the software/hardware upgradation from 3G to 4G and 10 lakh for green field which is L-2 but the conditions put forth by M/s ZTE is unrealistic. In addition to this the rates quoted by L-1 and L-2 alongwith conditions has not been approved by the BSNL Board since consensuses has not been reached. |

We further required 10000 to 12000 Crore for 4G launching and Rs. 5000 Crore for OFC maintenance. BSNL is paying Rs. 4000 crore towards bank interest and we can saved Rs. 6500 towards employee cost. Roughly we required 50,000 crore for our annual expenditure but our annual revenue is around Rs. 20000 crore. Hence for the deficit BSNL is depending on Sovereign guarantee bond to the tune of Rs. 8500 crore and monetization of vacant a***ets. He further mentioned that in the first week of April,2020, BSNL will get a Rs. 8500 crore Sovereign guarantee from Finance Ministry. 14 a***ets were identified by BSNL for monetization but DIPAM accepts only 11 a***ets to the commercial value of Rs. 18,200 Crore for which BSNL is expecting transactional advise within a week. Three MNCs come forward for purchase. Discussions has not been taken place due to COVID-19. |

We recall the discussions had with Director (HR) several times for the past two months in this regard and requested for early decision. Director (HR) mentioned that as per the Committee recommendations the grace marks has been already given. He further mentioned that our priority is remittance of Society recoveries made from the salaries of VRS Optees , January, 2020 Salary and remittance of GPF recoveries made from the salaries of the working employees.
